Head of the Judiciary, Mr. Larijani,
Copy to Mr. Ahmed Shaheed, Special Rapporteur of United Nations on the human rights situation in Iran
Hello,
Respectfully, I am Mohammad Abdollahi son of Ismael and have a case with the number *********. The charges in the case are acting against national security that the President of branch 2 of revolutionary court of Mahabad, Mr. Javadi kia, according to the verdict, knew me as Muhareb (enemy of God) and charged me with corruption on earth and issued my death sentence which was also confirmed in the Supreme Court after the due process of law. Due to serving 6 years since my arrest and the certainty of my verdict, I find it necessary to explain my situation and my case to the distinguished standing briefly and call for a fair hearing. I was arrested by the military and security forces in Mahabad and in Shaygan on March 19, 2011 and there my right shoulder was injured due to being shot by the officers at the scene and I was severely beaten by them that broke my right arm above the elbow and left leg from the calf and my teeth due to severe blows. I was transferred to the Intelligence detention of province in that poor health situation and no doctor referred to my cell. I was interrogated for a period of 90 days by officers. After completion of the initial investigations, the case was sent to the prosecutor of the Revolutionary Court in Mahabad. I was transferred to Mahabad prison. Then I was transferred to intelligence detention of Mahabad for the investigations, after the completion of the investigation and the case, I was summoned by Second Branch of the investigation, Mr. Zaheri and I was informed about the charges and that he had issued my acquittal after studying the case. But the head of branch 2 of the Revolutionary Court of Mahabad, Mr. Javadi Kia protested to prosecutor’s decision and returned the case to Ministry of Intelligence of Mahababd. This time the case was handled by branch 2 of the Revolutionary Court of Mahabad and my death sentence was issued by being known as Muhareb (enemy of God) and charged with corruption on earth. The judiciary process lasted three years and finally the verdict of the lower court was confirmed by the Supreme Court. I have served 6 years and 2 months so far. It should be noted that I had been sentenced to five years in prison and deported to Shahroud by the judiciary, due to involvement in the killing. After the expiration of the legal term, I demanded furlough by the judicial authorities of Shahroud which after approval was given to me by the prosecutor. But I was absent for a year due to family problems and the fear of arrest. I went to Iraq for a living and business. Sometimes I returned to Iran with some money and gave it to my family. Also in Iraq for facilitating of commuting and short stay, I had prepared a refugee card under the protection of Komala Party for myself. The last time I was arrested, no hot and cold weapons were seized except the card. I have not participated in any armed conflict against the security arms, police and armed forces of Iran.
Mr. Larijani
In Islam and the tradition of the leaders of this world ethnicity and nationality, color, language, race and even religion of the person does not effect the value of that person. The Quran has referred to the value and respect for human dignity in all children and descendants of Adam. Therefore, the attitude of the society in education, teaching and Islamic laws are explicitly expressing this truth and facts, that in the holy Quran, the dignity and inherent dignity have been considered due to being a human and even those who have a false belief will benefit from human rights. However, the Quran makes difference between the right and the false belief, still, everyone must recognize each other’s rights and try to observe it. In this regard, Hazrat Ali have said a beautıful sentence to one of his supporters “all people are equal with you in religion or in creation.”
Now according all these we cannot ignore the Islam and Sharia law which are streaming as an approval in our daily lives. We must adhere them sensitivity. Because Iran is an Islamic country and as such lawlessness and injustice causes many questions.
Mr. Larijani
My case which was established by provincial security forces, is very thick and has a collection of false accusations and is far from the truth, that I have not admitted them anywhere in the presence of any judicial and security officials and have claimed no enterprise and participation and membership and collaboration in any formal or informal parties, But I was sentenced to death after saying this sentence by branch 2 of the Revolutionary Court of Mahabad, Mr. Javadi kia: “With the power and strength of God and Holy Quran and with the permission of the Supreme Leader who let me execute or free anyone. I refer to the Supreme Leader’s fatwa now and I can execute or free you, but I sentence you to death on my own knowledge and I myself will execute you.”
As I mentioned these were stated by the judge and exporter of death verdict at my hearing and it can be easily understood there is no justice in this case. Is only a refugee card sponsored by an opposition party worth it that the Iranian regime carry out a heavy punishment? Are the justice of Islam and its religious orders executed by my execution? Does Mr. Javadi deserve to judge the children of this land by having such attitude? Does the Islamic judicial system entitle such judges? I remise the answer of these questions to Iranian people’s conscience.
Finally, I should say that according to notifications of ministry of intelligence, all factors related to the conflict that I was also arrested in and tried on the same charges, were killed in clashes with the military and security forces. I am sorry that I must communicate to you in this way, but hard demanding problems provide the underlying to devise means and remedy. I have never wanted to abuse or aske pardon and forgiveness from the presence of you except a fair trial and reconsideration of the case.
Respectfully,
Mohammad Abdollahi
