HRANA News Agency – Tehran Prosecutor’s Office in an illegal order, prevented Kamran Ayazi, political prisoner, from being released form Rajai Shahr prison in the last minute.
According to the report of Human Rights Activists News Agency in Iran (HRANA), on 22^nd July, while the family of Mr. Ayazi were waiting for his freedom from prison, after inquiry from enforcement office in Rajai Shahr Prison, Tehran prosecutor in an illegal action canceled the deduction of his sentence and prevented his freedom and announced January as his the date of his freedom.
However, according to a decree discount that was granted to him in 2013 (half of his sentence) and based on the enforcement office’s written discretion, the date of his freedom was stipulated as 11^th January 2013, and he should have been released following the administrative process.
In addition, Article 134 of the new Islamic Penal Code in the case of Mr. Ayazi has been applied, so that a single sentence (5 years) was approved for him.
Doctor Kamran Ayazi, dentist, for activities in cyberspace was detained on 23^rd January 2011 and after 8 days interrogation with beatings in the Intelligence General Office in Shiraz, was transferred to ward 209 of Evin Prison and for three months was interrogated in Tehran, and then was transferred to ward 350 of Evin prison.
On 17^th June 2011, Branch 26 of the Revolutionary Court in Tehran sentenced Dr. Ayazi to 9 years imprisonment. This sentence was later revised by Branch 54 of appeal court, presided by Judge Movahed, and it was confirmed, precisely.
After the security forces’ attack to ward 350 of Evin Prison, on 17^th April 2014, known as the Black Thursday, a new case was opened against Mr. Ayazi, and following that he was exiled to Rajai Shahr prison, in Karaj, on 23^rd June 2014. Mr. Ayazi was sentenced to 90 days in jail, because of this new case, but even with this new sentence, by the law, he should have been released from prison in July last year.
Mr. Ayazi has been prevented of being released, while, since he was arrested in 2010 till now he has been deprived of leave. This political prisoner has 3 children and his family leaves in Shiraz, so that his wife and children had to travel to Tehran from Shiraz. Prosecutor’s illegal action in cancelling the court of competent jurisdiction sentences convert, and enforcement office’s notice on the eve of the implementation of the new Criminal Procedure Code, once again has confirmed the claims about judicial authorities non-compliance with the current rules.
