HRANA News Agency – By accepting the retrial of Roein Utoofat in the Supreme Court, the case of this national-religious political prisoner in Evin Prison, has been referred to Branch 36 of the Appeals Court of Tehran province.
According to the report of Human Rights Activists News Agency (HRANA), after the complaints of Roein Utoofat compassion against the verdict last year, Branch 37 of the Supreme Court at the end of last August, had accepted the complaint of this political activist and had sent the case to the prosecutor for retrial.
On 17 September 2015, the Prosecutor also had sent the Supreme Court’s ruling to Evin prison with the intention of notifying the prisoner. This response has not been received by Roein Utoofat.
The national-religious activist’s case was referred to Branch 36 of the Tehran Appeals Court on the 19th October 2015, however the court had stated that the review of the case was not possible due to the failure of completion of judicial staff and upon completion of this staff this case would had been on the agenda.
It is said that after the retrial, Roein Utoofat has the possibility of being released on the bail.
It should be noted that his family have faced many problems in Tehran prosecution office such as lack of accountability of employees and bureaucracy.
In a conversation with the correspondent of HRANA, his wife announced her appointment with him on the 6the of December 2015, and said that after that meeting she was not allowed to give a book to her husband.
Earlier she was allowed to have a meeting with Mr. Utoofat, however because of the interview with the media, this meeting was prevented.
Some time ago, he was not allowed to participate in his university final exams. Prison authorities had stated that a delayed letter from the university was the reason of it, but as the prisoners said the letter had been received at least one month before by the prison.
It is worth mentioning that Mr. Utoofat himself as well as his family have also complained in regard to this issue and have demanded an investigation.
Roein Utoofat went to Evin prison to serve his ten years imprisonment and up to now has been deprived of having furlough.
Mr. Utoofat was arrested on 16 February 2012, during a cultural meeting at his own home by MIOS agents, and transferred to Evin prison. He was released on the bail from Evin prison after five months on the 19th July 2013.
The national-religious activist was summoned and tried on the charges of “establishing an illegal organization known as Council of Rainbow in collaboration with the illegal groups of national-religious (Meli – Mazhabi) and propaganda against the Islamic Republic by through issuing and signing anti-security statements” in the 8th June 2014 by Branch 15 of the Revolutionary Court, presided by Judge Salavati.
The court issued sentences to Roein Utoofat with 11 years in prison, two years deprivation of activities in political parties and groups and activity in cyberspace, the media which was changed to ten years in prison by Branch 54 of the Appeals Court and the rest of above- mentioned sentence remained unchanged.
Mr. Utoofat is currently serving his sentence in ward 8 of Evin prison.
