Soheil Babadi; 40 Months of Detention with no Imprisonment Sentence

HRANA News Agency – Soheil Babadi, prisoner of Rajai Shahr prison, after forty months of his detention and being sentenced in the primitive stage for one of the cases related to him, is still imprisoned without a definitive sentence.

According to the report of Human Rights Activists News Agency in Iran (HRANA), His first court verdict has not been notified to the Law-enforcement office, neither his second trial verdict has been issued. 

His wife told HRANA’s reporter, regarding his condition: “He is still held in undecided condition in the ward of apolitical prisoners in Rajai Shahr prison.”

Mrs. Babadi by explaining the circumstances of his case, said: “In his case, although the second part of his case in under investigations since 2 years ago, but the related Branch has not disclose any decisions yet.”

His charges in the second part are gathering and collusion, and insulting the leadership and he was tried already 3 months ago. His first sentence which was issued by the Criminal Court has not been sent yet to execution. It means that officially and after about forty months he is held in undecided condition.”

Sohail Babadi’s wife with announcing the primitive decision against this prisoner, said: “First sentence was 5 years imprisonment that has not been sent to the law-enforcement office yet. This decision must be notified so that he will become a prisoner with its minimum facilities. Unfortunately, they do nothing.”

Mrs. Babadi in response to the question whether the situation of the prisoner and the issue of uncertainty have been followed or not said: “I pursued many times. Also for the decision his lawyer, Mr. Kay-Khosravi, and we followed ourselves as well. Unfortunately the Branch 28 just procrastinates to issue the decision. However, we are not sure that the verdict will be a fair decision, or even the judge has read the case and he will talk about the documents’ reliability, but they even do not announce it.  We will pursue the issue. Rajai Shahr law-enforcement office says the Branch of Shahid Moghadas should notify us, Shahid Moghadas Branch says; Rajai Shahr prison must make a request, and then we will deliver it to them. They have put us in this play and we do not know that this Branch should notify or that Branch should request.”

“Their only aim is; to keep the case pending. They do not agree to release him on the bail. The Revolutionary Court says that the prisoner is not here and you should go to the law-enforcement office. The law-enforcement office says that the decision has not been finalized and we cannot get leave permission for him. It means that even after 40 months he cannot go on a two-day-leave.” She added

Mrs. Babadi also pointed to the cases similar to her husband’s case and said: “This is while similar cases to my husband’s case have been finalized. Several prisoners with the same case have been released on the bail or at least have gone on leave for several times or were included a commutation. But their only aim is keeping my husband in an undecided condition.”

Sohail Babadi was arrested in June 2012 for writing satirical pieces on the Facebook page known as “the campaign to remind the Shiites Imam Naghi”. Babadi, who was sentenced to 5 years imprisonment by the criminal court, and has another open case with charges of gathering and collusion and propaganda against the regime in Branch 28 of the Revolutionary Court, formerly in a letter which was publicized by HRANA, in September 2012, had announced about the beating and sexual and family allegations by his interrogators to put pressure on him to confess.  The pressures on his family cause her wife to miscarry her baby at the 4th month of pregnancy. Babadi has written in his letter in this regard: “The interrogator came to me after hearing this news during our phone call, (my wife’s phone tapping by intelligence) expressing his happiness, said; definitely it was a bastard child that had this fate.”
