The List of Male Prisoners with the Charge of Muharebeh and Life-Time Sentence

HRANA News Agency – Prisoners who have been charged with Muharebeh according to the old Penal Code, would find the chance of a retrial, after the changes and may receive reduction in their sentences or be released. Currently there are tens of prisoners who have been sentenced to life-time prison on charge of Muharebeh, at least 26 of whom are the men. The following list is the second list of prisoners with the charge of Muharebeh.

According to the report of Human Rights Activists News Agency (HRANA), at least 26 male prisoners are sentenced to life-time prison on charge of Muharebeh in different prisons around the country. Due to the changes in the Islamic Penal Code in 2013, these prisoners may request for a retrial. Some might receive reduction in their sentences and some others who have served many years in prison may get released.

According to the new Islamic Penal Code, the definitions of MUharebeh (waging war against the God), Fesad-Fel-Arz (Corruption on earth) and Baghy (sacrilege and belligerence), issued in 2013, in articles 279 to 288 were changed. According to part B of article 10 of the Islamic Penal Code issued in 2013, the judge is mandated to issue or execute the sentence according to the latest update of the law. Besides, defendants can request for a reduction of their sentences according to the new law.

The names of these prisoners along with some additional information which has been confirmed by HRANA are as following:

Mohammad Nazari

Charge: Muharebah through cooperation with a Kurdish opposition party (Democratic party of Kurdistan)

Date of arrest: May 29, 1994

Sentence: life-time prison

Prison/detention centre: Rajaei Shahr prison of Karaj (Gohardasht)

Medical condition: He is suffering from heart disease and slipped disc, and has been deprived of furlough and proper medical treatment for 22 years

Khaled Fereydooni

Charge: Muharebah through cooperation with a Kurdish opposition party (Democratic party of Kurdistan)

Date of arrest: September 1999

Sentence: life-time prison

Prison/detention centre: Rajaei Shahr prison of Karaj (Gohardasht)

Description: Since more than 16 years ago, he has been deprived of furlough

Omar Faghihpoor

Charge: Muharebah through cooperation with a Kurdish opposition party (Democratic party of Kurdistan)

Date of arrest: September 1999

Sentence: life-time prison

Prison/detention centre: Rajaei Shahr prison of Karaj (Gohardasht)

Description: when he was arrested, his daughter was 3 years old and he has never been able to be with his family during the last 17 years

Charge: Muharebah by cooperation with opposition Arab parties

Date of arrest: 1996

Description: Two of his brothers were executed in 2007

Karim Maroof Aziz

Charge: Muharebah by cooperation with foreign governments (Iraqi Baath regime)

Date of arrest: 1996

Description: He is an Iraqi citizen and has served in prison for many years

Need to be mentioned that the list above is the second list of the prisoners with Muharebeh charges in Iran’s prisons. HRANA will continue to publish the list of other prisoners, with the intention of attracting the public attention and with the hope that it would help improve the condition of political prisoners in Iran.
