Workers’ Rights Activist Asal Mohammadi Taken for Sentencing

On July 11, 2022, workers’ rights activist Asal Mohammadi was taken to Evin prison to serve her one-year sentence.

According to HRANA, the news agency of Human Rights Activists, workers’ rights activist Asal Mohammadi appeared at the Evin Judgement Enforcement Unit for sentencing.

Earlier, Branch 26 of the Tehran Revolutionary Court sentenced Mohammadi to one year and eight months in prison and banned her from civil and political activities for two years on the charges of “propaganda against the regime and assembly and collusion against national security”. This verdict was upheld on appeal. Based on Article 134 of the Islamic Penal Code, the one-year sentence is enforceable.

Mohammadi’s lawyer, Iman Soleimani, told HRANA, “During the detention, Mohammadi did not have access to a lawyer. During the trial process, I took her case but was not allowed to study the case documents or attend court sessions, which is a violation of Article 48 of the Criminal Procedure Code. Mohammadi was in poor mental condition. Contrary to what the law explicitly states, she had been interrogated without the accompaniment of a lawyer”.

On January 24, 2022, the trial was held and during the trial, participation in online campaigns such as “white torture” or membership in Marxist groups was used as evidence for the charges.

On November 6, 2021, the security forces arrested Mohammadi and Hirad Pirbodaghi.

On November 11, Mohammadi was transferred to Public Ward 209 of Evin Prison and was released on bond on November 22, 2021.

Workers’ Rights Activist Hirad Pirbodaghi Sentenced to Four Years and Eight Months In Prison

Branch 26 of the Revolutionary Court of Tehran sentenced workers’ rights activist Hirad Pirbodaghi to four years and eight months in prison, two years prohibition from membership in political parties and groups, and a two year ban from leaving the country. If the verdict is confirmed on appeal, four years imprisonment as the severest punishment of one count will be enforceable for him.

According to HRANA, the news agency of Human Rights Activists, he was charged with “propaganda against the regime and assembly and collusion against national security”.

As examples of the above-mentioned charges, the courts have cited frequent referring to Electronic Judicial Services Offices and complaints about detention conditions in solitary confinement.

On November 6, 2021, Pirbodaghi was arrested violently by security forces alongside Asal Mohammadi. Their houses were searched during the arrest. He was held in Ward 209 of Evin Prison until December 24, when he was relocated to the Public Ward of Evin Prison. On January 1, 2022, he was released on bail.

Asal Mohammadi Sentenced to One Year and Eight Months Imprisonment

Branch 26 of the Revolutionary Court of Tehran sentenced workers’ rights activist Asal Mohammadi to one year and eight months in prison and a two years prohibition on membership in any political or civil group.

According to HRANA, the news agency of Human Rights Activists, Mohammadi was charged with “propaganda against the regime” and “assembly and collusion against national security.” If confirmed on appeal, the one-year sentence on one count will be enforceable.

Her lawyer, Iman Soleymani, told HRANA that “During the detention, she had no access to a lawyer. During the trial process, I undertook her case but they did not allow me to study the case documents or attend the court, which is in violation of Article 48 of the Criminal Procedure Code. She was in poor mental condition. Contrary to what the law explicitly states, she had been interrogated without accompaniment of a lawyer during the interrogation”

On November 6, 2021, she was arrested violently along with Hirad Pirbodaghi by security forces. Their house were searched.

Five days later, on November 11, she was transferred to Public Ward No. 209 of Evin Prison and was released on bond on November 22, 2021.

Hirad Pirbodaghi’s Mother, Setareh Jalali, on Sit-Down Strike

Setareh Jalai, the mother of Hirad Pirbodaghi, went on a sit-in in front of Evin Courthouse in cold weather on December 5. The strike was in protest of her son’s continued detention and the lack of information regarding his condition. She was informed yesterday by prison and court officials that Pirbodaghi’s case will be taken to court for examination within the next 48 hours. This news is at odds with prior information the court has granted his release on bail. 

According to HRANA, the news agency of Human Rights Activists, the workers’ rights activist is still detained and awaiting legal proceedings in Ward 209 of Evin Prison in Tehran after 30 days.

In phone calls, Pirbodaghi stated that he had been under extreme coercion by security forces to confess.

“Last Saturday, they called her mother to provide the bail of 800 million tomans (189,680 USD). As her mother told me, the letter was issued on November 24, indicating that the security forces had obstructed the execution of this order,” an informed source told HRANA. “When the family went to Evin Courthouse, they were told that for now, the release is not going to happen. On the second day of her sit-down strike, however, Hirad’s mother was told to meet with prison officials”.

In this meeting, she was told that the case will be sent to a branch of the court for examination within the next 48 hours.

On November 6, Pirbodaghi was arrested violently by security forces alongside Asal Mohammadi. Their houses were searched during the arrest. He was transferred to Ward 209 of Evin Prison, which is at the disposal of the Ministry of Intelligence.

Pirbodaghi was indicted on the charges of “assembly and collusion against national security” on November 7.

Mohammadi was released on bond from Evin Prison on November 22. The reason for his arrest is still unknown at the time of writing.

The day before their arrests, Pirbodaghi and Mohammadi, accompanied by seven other activists, had filed a complaint in a judicial office against the use of solitary confinement as a torture method. Mohammadi and Pirbodaghi have previously faced other arrests and convictions for their non-violent activism and worker’s rights advocacy.

Hirad Pirbodaghi Still In Detention After 25 Days

After 25 days, workers’ rights activist Hirad Pirbodaghi is still detained and awaiting legal proceedings in Ward 209 of Evin Prison in Tehran.

According to HRANA, the news agency of Human Rights Activists, Pirbodaghi confirmed during a phone call with his family that interrogations have finished and he is waiting for bail to be assigned so that he may be released. The Evin Prison court has refused to set bail despite multiple requests from his family.

“In these increasingly cold days, he has been given just one set prison uniform which he has to wash and wear while it is still wet. Moreover, they don’t allow him to purchase anything from the prison store”, an informed source told HRANA.

Two workers’ rights activists were arrested by security forces on Saturday, November 6.

According to HRANA, the news agency of Human Rights Activists, on Saturday, Hirad Pirbodaghi and Asal Mohammadi were arrested yesterday after security forces searched their homes. Hirad Pirbodaghi made a phone call to his family earlier this morning and informed them that he is currently being held in the notorious Ward 209 of Evin Prison. Mohammadi’s situation and whereabouts are still unknown as of this writing.

An informed source told HRANA that security forced raided and searched their houses violently. Sunday morning, Hirad Pirbodaghi was notified about the charges against him, which include “assembly” and “collusion”.

Asal Mohammadi and Hirad Pirbodaghi have previously faced other arrests and convictions for their non-violent activism and worker’s rights advocacy.

Yesterday, before their arrest, Pirbodaghi and Mohammadi, along with seven other civil activists, filed a complaint in a judicial office against using solitary confinement as a tool of torture.

As of yet, the reason for these arrests is unknown.
